As part of the Final IPPS, CMS issued a series of Stark Law changes, affecting “per click” agreements, “under arrangement” arrangements, gainsharing, pay-for-performance initiatives, and value-based purchasing arrangements.
The new, finalized law describes what is and is not acceptable in hospital / physician partnerships, closing many of the previously cited “loopholes” in the regulations. Programs that are now non-compliant will have until October 2009 to unwind their current agreements.
